Article 1: General provisions

EDU-TECH, a private limited company, located at Maria-Theresiastraat 45 3000 LEUVEN, VAT BE0695432689, RPR department Leuven, (hereinafter 'EDU-TECH') offers its customers the opportunity to purchase products and services.

The present General Terms and Conditions (“Terms”) apply to every order placed (“Customer”). When placing an order via the web shop, email, telephone, or any other communication medium, the Customer must expressly accept these Terms, thereby agreeing to the applicability of these Terms, to the exclusion of all other terms. Additional terms from the Customer are excluded, unless they have been expressly accepted in writing by EDU-TECH in advance.

Article 2: Price

All prices mentioned are expressed in EURO, always excluding VAT and all other taxes or charges that the Customer is obliged to bear, unless stated otherwise. If transport, delivery, reservation, or administrative costs are charged, this will be stated separately.

The price stated refers solely to the items or services as described in words. The accompanying photos are intended for decorative purposes and may contain elements that are not included in the price.

Article 3: Offer

Despite the fact that the online catalogue and the e-commerce websites are compiled with the utmost care, it is still possible that the information provided is incomplete, contains material errors, or is not up to date. Obvious mistakes or errors in the offer do not bind EDU-TECH. EDU-TECH is only obliged to a best-efforts commitment regarding the accuracy and completeness of the information provided. In no case shall EDU-TECH be liable for manifest material errors, typographical errors, or printing mistakes.

When the Customer has specific questions regarding e.g. specifications, limitations, availability, delivery time or delivery method, we request the Customer to contact our customer service in advance.

The offer is valid as long as stocks last and can be adjusted or withdrawn by EDU-TECH at any time. EDU-TECH cannot be held liable for the unavailability of a product. If an offer has a limited validity period or is subject to conditions, this will be explicitly stated in the offer.

Article 4: Payments

The Customer has the choice between the following payment methods:

  • via credit card, debit card or other digital payment methods
  • via bank transfer

EDU-TECH is entitled to refuse an order due to a serious breach by the Customer in relation to orders involving the Customer.

Article 5: Delivery and execution of the agreement

Items ordered can be delivered by a delivery service chosen by EDU-TECH itself.

Unless otherwise agreed or expressly stated, the goods will be delivered to the Customer's official address within 30 days of receipt of the order. EDU-TECH is not liable for delays caused by external partners responsible for the delivery.

Any visible damage and/or qualitative shortcoming of an item or any other deficiency in the delivery must be reported by the Customer to EDU-TECH without delay.

The risk of loss or damage passes to the Customer as soon as he (or a third party designated by him, who is not the carrier) has physically taken possession of the goods.

Edu-Tech reserves the right to cancel or reschedule a planned course to another date, without being held liable and without compensation. In the event of cancellation of a training session, Edu-Tech will notify the participants in a timely manner. If a training session needs to be rescheduled, participants who have already registered may withdraw.

Article 6: Retention of Title

The delivered items remain the exclusive property of EDU-TECH until full payment has been made by the Customer.

The Customer undertakes to inform third parties of the ownership retention of EDU-TECH if necessary, e.g. to anyone who might seize the articles that have not yet been fully paid for.

Article 7: Right of Withdrawal

Cancellations for a group training or training at your school must always be done in writing (by email) to [email protected].

The following rules apply:

  • The cancellation only takes effect after the Customer has received a confirmation of the cancellation from [email protected].
  • Cancelling more than one month before the start of the training can be done free of charge.
  • If cancelled less than one month before the start of the training, 100% of the amount remains payable.

 

Cancelling an online course is not possible. If you cannot attend live, you still have access to the recording and/or the digital materials.

 

Cancellations for a certification must always be made in writing (by email) to [email protected].

The following rules apply:

  • The cancellation only takes effect after the Customer has received a confirmation of the cancellation from [email protected].
  • Cancelling more than one month before the start of the certification can be done free of charge, except for the price of the exam (voucher) itself.
  • If cancelled less than one month before the start of the certification, 100% of the amount remains payable.

Article 8: Guarantee

The provisions of this article apply only to Customers who purchase items online from EDU-TECH in their capacity as consumers. Business customers cannot invoke consumer guarantees. They can only rely on the manufacturer's warranty.

Under the law of 21 September 2004 concerning the protection of consumers in the sale of consumer goods, the consumer has legal rights. This legal guarantee applies from the date of delivery to the first owner. Any commercial guarantee does not affect these rights.

To make a claim under the warranty, the Customer must be able to provide proof of purchase. Customers are advised to keep the original packaging of the goods.

For items that were purchased and delivered to the Customer's home, the Customer must contact the EDU-TECH customer service and return the item at their own expense to EDU-TECH.

Upon discovering a defect, the Customer must inform EDU-TECH as soon as possible. In any case, any defect must be reported within a period of 2 months after it has been identified by the Customer. Thereafter, any right to repair or replacement shall expire.

The (commercial and/or statutory) warranty does not apply to defects arising from accidents, neglect, falls, use of the item contrary to the purpose for which it was designed, failure to comply with the instructions for use or manual, modifications or alterations to the item, rough handling, poor maintenance, or any other abnormal or incorrect use.

Defects that manifest after a period of 6 months following the date of purchase, or delivery if applicable, are deemed not to be hidden defects, unless proven otherwise by the Customer.

Article 10: Sanctions for Non-Payment

Notwithstanding the exercise of other rights held by EDU-TECH, the Customer shall, in the event of non-payment or late payment, from the date of default and without prior notice, owe interest of 10% per annum on the unpaid amount. Furthermore, the Customer shall, by operation of law and without prior notice, owe a fixed compensation of 10% on the relevant amount, with a minimum of 25 euros per invoice.

Notwithstanding the above, EDU-TECH reserves the right to reclaim items that have not been (fully) paid for.

Article 11: Privacy

The data controller, EDU-TECH, complies with the General Data Protection Regulation and the Belgian Privacy Act of 30 July 2018.

The personal data you have provided will only be used for the following purposes: the execution of the concluded agreement, processing the order, sending newsletters, advertising and/or marketing purposes. The legal grounds are: the execution of the agreement, consent, fulfilling legal and regulatory obligations and/or the legitimate interest of the business.

You have a legal right to access and, if necessary, correct, supplement or delete your personal data. In certain cases listed in the GDPR, you may also request to restrict the processing of your personal data. You can also object to the processing of your personal data if you have serious and legitimate reasons that outweigh our necessity to process your data. By submitting a written, dated, and signed request to EDU-TECH, you can request your personal data in a digital and readable format free of charge and/or have it transferred to other controllers. As far as our processing is based on your prior consent, you have the right to withdraw that consent.

In the event of data being used for direct marketing: You can object free of charge to the use of your data for direct marketing and do not need to provide a reason for this.

We treat your data as confidential information and will not disclose, rent, or sell it to third parties. It is possible that the obtained personal data may be shared with companies that collaborate with us.

Article 12: Use of cookies

Article 13: Impairment of validity - non-waiver

If any provision of these Terms is declared invalid, illegal or void, this shall in no way affect the validity, legality and applicability of the other provisions.

The failure at any time by EDU-TECH to enforce any of the rights listed in these Terms, or to exercise any right hereunder, shall never be construed as a waiver of such provision and shall never affect the validity of these rights.

Article 14: Amendment of Conditions

These Terms are supplemented by other terms to which explicit reference is made, and the general sales conditions of EDU-TECH. In the event of a conflict, these Terms shall take precedence.

Article 15: Evidence

The Customer accepts that electronic communications and backups may serve as evidence.

Article 16: Applicable Law - Disputes

Belgian law shall apply, with the exception of the provisions of international private law regarding applicable law.

The courts of the Consumer's place of residence have jurisdiction in legal disputes. The Consumer can also turn to the ODR platform (http://ec.europa.eu/consumers/odr/).
